Hedge Fund Offers Clearwire Additional $80M in Financing

Aurelius Capital Management has offered Clearwire $80 million in funding to further entice the WiMax wholesaler away from Sprint’s funding offer.

In a letter to Clearwire’s board, Aurelius explains that its financing offer would be on similar terms to that of Sprint’s except that its notes would be exchangeable for Clearwire stock at $2 per share as opposed to the $1.50 per share offered by Sprint.

The aggressively worded letter explains that Aurelius’ offer of $80 million is meant to be taken as a supplement to the $240 million Clearwire minority shareholder Crest Financial offered last week. Aurelius suggests the remaining $160 million in funding it would take to equal the $480 million Sprint still has on the table for Clearwire would come from other investment sources.

Android dominance targeted in Microsoft, Nokia antitrust complaint

FairSearch, a coalition of 17 technology and search firms including Microsoft (NASDAQ:MSFT), Nokia (NYSE:NOK), Oracle, Expedia and Hotwire, has filed a formal complaint with European antitrust regulators alleging that Google (NASDAQ:GOOG) is exploiting its open-source Android mobile operating system to "cement its control over consumer Internet data for online advertising as usage shifts to mobile."

Google is using Android as a low-cost "'Trojan Horse' to deceive partners, monopolize the mobile marketplace and control consumer data," said Thomas Vinje, an attorney representing the FairSearch group, citing contractual agreements requiring Android device manufacturers to pre-install Google apps and services and award them prominent default placement. The complaint calls on EU officials to probe Google's "deceptive conduct to lockout competition" in the mobile market, adding "Failure to act will only embolden Google to repeat its desktop abuses of dominance as consumers increasingly turn to a mobile platform dominated by Google's Android."

Apple's app dominance is ready to be challenged

Leave it to Walter Mossberg to explain what should be glaringly obvious to the entire world. In a recent Wall Street Journal column the gadget guru addressed a question that probably still comes off the lips of its executive readers who buy a Windows Phone 8 device and wonder why it doesn't have Siri.

In "How Apple gets all the good apps," Mossberg points out that unlike Google (NASDAQ:GOOG) or Amazon, which are largely software firms that dabble in hardware, Apple (NASDAQ:AAPL) relies on stellar smartphone sales to drive the company's innovations and profits. It has been the same model since the days Apple was just a computer company.Read Report

When T-Mobile USA announced its "Uncarrier" strategy in late March it also revealed that it would effectively be sidelining its spokeswoman Carly Foulkes, widely known as the T-Mobile Girl. She first appeared in pretty magenta-tinged dresses and then in the spring of 2012 started donning the black leather of a biker as part of T-Mobile's "No More Mr. Nice Girl" campaign to highlight the carrier's "4G" HSPA+ network.

"The current campaign will not feature the character of the T-Mobile Girl, however she is still a part of the company's brand family," a T-Mobile spokesperson told Business Insider.

So, in theory, Carly could make a comeback, but more than likely she'll be pushed aside for T-Mobile's new "Uncarrier" messaging, which so far features an ad with cowboys designed to highlight how T-Mobile is breaking with other carriers by ditching contracts.

Hello Businesses Owner,

I am writing to you because our changing health care system will have a profound effect on all of us. Now that the election is over and the Supreme Court has ruled, the Affordable Care Act (ACA) is not going away. It will not be repealed and it is up to us to make sure it will work for small businesses and individuals as it was intended to do.

That’s why I joined the Campaign for Better Health Care’s newly created Small Business Health Care Consortium (SBHCC). This consortium views the needs of small businesses and their employees as a top priority.

And, as a member of the Steering Committee of the SBHCC I am personally inviting you to join our network of small businesses who know that only through our collective voices that will assure that the Affordable Care Act live up to its goal of making healthcare affordable for all.

Discussions around health reform have been confusing and, sometimes, even misleading. It is the goal of the SBHCC to provide factual information about the changes that are already happening and those coming in the near future. The SBHCC discusses the benefits and opportunities of the ACA and what Illinois small businesses need to do to make sure this law will benefit them.

Many key components of the ACA are national in nature. For instance, small businesses currently providing health insurance to their employees could be eligible for a 35% tax credit. And, while employers with fewer than 50 full time employees are not required to provide health insurance, their employees can take advantage of the ACA’s benefits.

Other components will be implemented at the State level and these decisions will either enhance small businesses or provide another hurdle. One important component is that all states must implement a health insurance exchange (marketplace). These exchanges will include a rate review process with defined, easy to understand plans to consider and review side-by-side.

As small business owners we share many of the same, serious business challenges. It is my hope that you and your small business peers do want to learn more about the ACA. Let’s take this opportunity to act collectively to get control of health insurance costs and improve access to coverage. The opportunity to create positive change is now. It is about fairness and choices for small businesses. To that end I like for you to hear my own personal story about how the new healthcare law will effect me.
